These Website Terms and Conditions ("Terms") govern your use of the Lydia Harris Entertainment website and its forms, content, links, embedded media, artist-submission opportunities, Lydia Selects information, booking and management inquiries, and related features (collectively, the "Website"). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. About the Website
The Website provides information about Lydia Harris Entertainment, Lydia Harris, affiliated projects, artists, media, booking, management, partnerships, Lydia Selects, and related opportunities. Website content is provided for general informational and promotional purposes and may change without notice.
2. Eligibility
You must be at least 13 years old to use the general Website. You must be at least 18 years old and able to enter a binding agreement to submit music, request booking or management services, apply for an opportunity, or agree to any release. A parent or legal guardian must act for a minor where permitted.
3. No Automatic Business Relationship
Visiting the Website, submitting a form, sending music, following a social-media page, receiving a reply, or being featured in promotional content does not by itself create an artist-management, recording, publishing, distribution, booking, agency, employment, partnership, joint-venture, fiduciary, or other contractual relationship with LHE or Lydia Harris.
No booking, representation, placement, sponsorship, partnership, or professional service is final unless the authorized parties sign a separate written agreement. Website descriptions of possible opportunities are not guarantees or binding offers.
4. Submissions and Artist Ownership
You retain ownership of original music, video, images, artwork, biographies, and other creative materials that you submit.
By submitting materials, you give LHE a limited, non-exclusive, royalty-free permission to access, store, internally copy, and share them with LHE team members and approved professional advisers solely to review the submission, evaluate a potential opportunity, maintain submission records, and communicate with you. This limited review permission does not transfer ownership to LHE.
LHE may publicly display or promote submitted material only when you separately authorize that use through a clear permission, campaign release, direct written approval, or another agreement. Any broader commercial rights must be stated in a separate written agreement.
5. Your Submission Promises
When you submit materials, you represent that the information is accurate; you are the owner or have authority from the owner to submit the materials; you have identified or cleared relevant collaborators, featured performers, producers, samples, compositions, recordings, images, and other third-party rights as required; and LHE's permitted review of the materials will not violate another person's rights or an agreement that binds you.
Do not submit confidential information, unreleased trade secrets, highly sensitive personal data, or material that you are not authorized to disclose. If confidentiality is necessary, arrange a separate written confidentiality agreement before sending the material.
6. Review, Selection, and Opportunities
LHE may decide whether, when, and how to review or respond to any inquiry or submission. Submission does not guarantee review, feedback, response, selection, placement, representation, booking, promotion, partnership, or compensation.
LHE may consider other artists, songs, concepts, projects, or materials that are similar in theme, style, title, subject matter, or idea. Similarity alone does not establish that LHE copied or used a submission.
Unless a specific campaign rule states otherwise, initial website submission is free. Any optional professional service, commercial arrangement, or paid opportunity must be described separately and will not influence Lydia Selects judging or initial consideration.
7. Lydia Selects
Lydia Selects is an artist-discovery and promotional initiative. Campaign timing, eligibility, selection criteria, voting or audience-engagement methods, promotional features, and available opportunities may be described in separate official campaign rules. If campaign rules conflict with these general Terms, the campaign rules control for that campaign.
Audience response may inform a campaign but does not create a right to selection. LHE may verify eligibility, remove fraudulent or manipulated activity, decline inappropriate content, and protect the integrity of the campaign. Sponsor or partner payments must not determine artist selection.
8. Media, Links, and Embedded Content
The Website may provide links to or embed interviews, performances, music videos, social-media posts, streaming content, press coverage, booking materials, and other third-party media. External services control their own availability, data practices, advertising, and terms. LHE is not responsible for third-party websites or platforms and does not guarantee that external content will remain available.
A link or embed does not necessarily mean LHE owns, sponsors, or endorses all statements or services appearing on the third-party platform. Rights in third-party media remain with their respective owners.
9. Booking, Management, and Business Inquiries
Information submitted through booking, management, media, sponsor, partnership, or general inquiry forms is an initial request only. Dates, pricing, scope, approvals, travel, production requirements, rights, payment, cancellation, and other terms are not final until confirmed in a separate written agreement by an authorized representative.
10. Intellectual Property
Except for user submissions and third-party materials, the Website and its text, graphics, logos, branding, page design, photographs, audio, video, compilations, and other content are owned by or licensed to LHE and are protected by applicable intellectual-property laws. You may view and share public Website links for personal, editorial, or legitimate business-reference purposes. You may not copy, reproduce, modify, distribute, sell, impersonate, scrape, or commercially exploit Website content without written permission or another lawful basis.
Lydia Harris Entertainment, Lydia Selects, related logos, slogans, and brand elements may be trademarks or protected identifiers. No license to use them is granted except in writing.
11. Acceptable Use
You may not use the Website to violate law or another person's rights; submit false, deceptive, infringing, defamatory, threatening, hateful, obscene, malicious, or unauthorized material; upload malware or harmful code; interfere with security or operation; harvest data or contact information; impersonate another person or organization; manipulate voting or campaign engagement; or attempt unauthorized access to any system or account.
12. Copyright Concerns
If you believe Website content infringes your copyright, email lharrisentertainment@gmail.com with your name and contact information; identification of the copyrighted work; the location of the material at issue; a good-faith statement that the use is not authorized; a statement that your notice is accurate and that you are authorized to act; and your physical or electronic signature. LHE may request additional information and may remove or restrict content while reviewing a claim.
13. Disclaimer of Warranties
To the fullest extent permitted by law, the Website is provided "as is" and "as available." LHE does not guarantee uninterrupted or error-free operation, the availability of third-party links or embeds, the accuracy or completeness of all content, or any particular result from using the Website or submitting materials. Nothing on the Website is legal, financial, or investment advice.
14. Limitation of Liability
To the fullest extent permitted by law, LHE and its owners, officers, team members, contractors, artists, affiliates, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, lost data, or reputational harm arising from or related to the Website, third-party services, an inquiry, or a submission. Where liability cannot be excluded, it will be limited to the extent permitted by applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless LHE and its owners, officers, team members, contractors, and affiliates from third-party claims, damages, losses, and reasonable costs arising from material you submit, your violation of these Terms, your infringement of another person's rights, or your unlawful misuse of the Website. This section does not apply to the extent a claim results from LHE's own unlawful conduct.
16. Suspension and Removal
LHE may restrict access, reject or remove a submission, disable a link or feature, or take other reasonable action when necessary to enforce these Terms, comply with law, protect rights or safety, prevent abuse, or preserve campaign integrity.
17. Governing Law and Disputes
These Terms are governed by applicable United States law and the law of the state in which LHE maintains its principal place of business, without giving effect to conflict-of-law rules. Before filing a formal claim, the parties should make a good-faith effort to resolve the issue through written communication. Any dispute that is not resolved informally will be brought in a court with lawful jurisdiction and proper venue, unless the parties agree in writing to another process.
18. Changes to These Terms
LHE may update these Terms as the Website, services, campaigns, or legal requirements change. Updated Terms become effective when posted with a new effective date. Continued use of the Website after an update means you accept the revised Terms to the extent permitted by law.
19. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, official campaign rules, and any separate written agreement that applies to a specific transaction, form the applicable agreement concerning the Website. A separately signed agreement controls if it expressly conflicts with these general Terms.
